Drunk driving is something that you should work very hard to avoid, but if you have already been charged or convicted of drunk driving, there are several things that you can do to get your life back on track. You’ve made a mistake, and hopefully you have learned from it, and it is a mistake that you will not repeat.

1.    Hire an attorney. Never go to court on a drunken driving charge without the services of drink driving solicitors. Many attorneys specialize in drunken driving cases, and this is the attorney that you want.

2.    If you are convicted, make sure that you have a very clear understanding of what the court now requires of you. There will be fees and fines, and you need to know how the court expects these fees and fines to be paid to them. Get a list of all requirements in writing.

3.    You will most likely be required to either serve jail time, or to participate in drink driving rehabilitation. If a rehabilitation program is offered, take it, and make sure that you get a list of approved programs from the court.

4.    Find out about regaining your driving privileges. Most states will have specific guidelines concerning your driving privileges after a drinking drunk driving conviction. Make sure that you fully understand the guidelines.

5.    Get insurance comparisons for drink driving insurance. Your rates are going to go up, and you may need to find a new insurance company once your license is reinstated.

Drunk driving is very costly in terms of time and money – and in tragic cases, human life. Hopefully, this is a mistake that you will not repeat the next time alcohol drinking takes place. In fact, you probably won’t, which is exactly why states and insurance companies make it so hard for you once you are convicted of drunk driving – so that you never forget it.

If you get stopped by a policeman, and he suspects that you have been drinking, he may request that you take a drink driving breath test. While not all states perform side of the road drink driving breath tests, more and more states are becoming equipped for this.

Even if the state does not do drink driving breath tests on the side of the road, all states have sobriety tests that they use, and if you do not pass that test, you will be taken to the police station immediately for a drink driving breath test.

If you refuse breath test, you will immediately be arrested for drunk driving. In some states, if you refuse breath test, you are actually committing yet another crime, for which you can be charged and prosecuted. However, there are certain steps that you should take before submitting to a breath test.

First, when asked to take the breath test, ask to see your attorney. Make it clear that you are not refusing the test, but that you must speak to your attorney before you do or say anything else. Stick with that, even if the police try to pressure you into taking the test while you wait for your attorney.

You see, the breath test measures the amount of alcohol that is currently in your blood. If you have the opportunity to tell your attorney to take his or her time in getting to the police station, this buys you more time, so that the blood alcohol content could actually become lower, and possibly within legal limits, before you take the test. Breath test limits in most states are .08%. If you are at or over that number, you fail breath test, and you can and will be charged with drunk driving.

Your attorney, once he or she arrives, may suggest that instead of a breath test, they would prefer a blood test. This determination may be made after your attorney sees how drunk you may be, and again, this is another tactic that can be used to delay any testing, as it will take a little time for the police station to arrange for the blood test.

If you have a charge drunk driving on your record, you may have to work very hard to get your drink driving licence back. More and more states are doling out extremely hard driving penalties for those who have charge drunk driving on their record.

You may be required to attend and complete some type of alcohol awareness class. This may be called different things in different states, but the course will focus on the dangers of drunk driving as well as the consequences of drunk driving. In most cases, you will be required to pay for the cost of this course yourself.

There may be other courses that you are required to take before you will receive your drink driving license and the privilege of driving once again. Again, your state will notify you as to what courses are required to obtain your license.

Most states will require you to obtain an SR-22 before they will reinstate your drink driving license. This is a form issued by your insurance company that keeps the state informed as to the status of your motor vehicle insurance. There is a charge for this form, and it is added to your monthly premium payments.

The SR-22 proves that you are carrying the required amount of car insurance, and if that insurance lapses, the state is notified, and you no longer meet the requirements for your drink driving license – meaning that it will be suspended again.

There may be other requirements and obligations that you must meet in order for the state to reinstate your drink driving license as well. Again, each state has its own rules, and you can be sure that those rules must be followed if you want to drive again after any drink driving offences or when drink driving conviction codes appear on your driving record.
